Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Drip Code platform at dripcode.xyz and app.dripcode.xyz (the “Service”), operated by Drip Code (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Drip Code is an AI-powered content automation pipeline. The Service scrapes trend inspiration, generates original AI videos and captions for your AI influencer characters, and posts that content to connected social media platforms on your behalf, subject to your configuration and plan limits.

To use the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information;
• Keep your login credentials secure and confidential;
• Be responsible for all activity that occurs under your account; and
• Maintain one account per user unless we agree otherwise in writing.

You must be at least 13 years old to use the Service.

You agree not to use the Service to:

• Create, generate, or post illegal, infringing, or harmful content;
• Send spam or engage in deceptive or manipulative practices;
• Impersonate any person or entity, or misrepresent your affiliation; or
• Violate the terms of service or community guidelines of any connected platform, including Instagram, TikTok, YouTube, and X.

You are solely responsible for ensuring your use of the Service complies with all applicable third-party platform rules.

The Service is offered on a subscription basis. Paid plans are Starter ($29/month) and Pro ($99/month); Enterprise pricing is available on request. New accounts include a 7-day free trial.

Subscriptions are billed through Stripe and automatically renew at the end of each billing period until cancelled. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel at any time from your dashboard.

Payments are non-refundable, and we do not provide refunds or credits for partial billing periods, unused time, or partial months. To avoid being charged for the next billing period, cancel before your subscription renews; you will retain access until the end of the current period.

You own the content generated through your account. Drip Code claims no ownership over your characters, media, or captions. You grant us only the limited license necessary to host, process, and post that content to the platforms you connect, for the purpose of operating the Service.

The Service produces AI-generated content. You are solely responsible for reviewing and ensuring that any content generated and posted through your account complies with the rules of the destination platforms, applicable laws, and the rights of third parties. We make no warranty regarding the accuracy, legality, or suitability of AI-generated output.

We aim to provide reliable access and target 99% uptime, but we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. The Starter and Pro plans are provided without a service level agreement (SLA). We may modify, suspend, or discontinue any part of the Service at any time.

We may suspend or terminate your account if you violate these Terms or use the Service in a way that could cause harm to us, other users, or third parties. You may cancel your subscription and close your account at any time. Upon termination, your right to use the Service ceases immediately.

To the maximum extent permitted by law, Drip Code and its affiliates, officers, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. The Service is provided “as is” and “as available” without warranties of any kind.

You agree to indemnify, defend, and hold harmless Drip Code and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to the content you create, generate, or post through the Service, or your violation of these Terms or any third-party rights.

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in North Carolina.

We may revise these Terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
